Step 1
The process control qualified individual (PCQI) does an initial evaluation of the type of foreign supplier to establish FSMA requirements and collect the documents needed to create the FSVP plan.
Step 2
The PCQI identifies hazards for each type of food, performs a risk analysis and determine appropriate controls that must be performed by the foreign supplier.
Step 3
Based on the foreign supplier documentation (HACCP, FSMA FSP, records) the qualified individual determines if the supplier is approved or corrective actions are needed. Also establishes the frequency of specific verifications activities to be performed throughout the year.
Step 4
Ongoing verification activities and records review are performed throughout the year to ensure the identified hazards are controlled. Records must be kept at least 2 years.
Step 5
The foreign supplier is reevaluated every three years or sooner if theres is new information on the hazards or if the product or supplier processes change.

What is an FSVP and why do you need it?
Before importation of food into the US, all import businesses are required to verify their foreign supplier's food production operations offer the same level of public health protection as the preventive controls requirements in the FSMA rule, and ensure the food products are safe for U.S. consumers.

This requirement is described in the federal regulation 21 CFR Subpart L and is called Foreign Supplier Verification Program (FSVP). The importer, U.S. owner or consignee of the food offered for import, is the responsible person to develop and maintain the FSVP for each food product and supplier.

What importation activities require a modified FSVP?
  • Importation of foods that cannot be consumed without the hazards being controlled (e.g. cocoa and coffee beans).
  • Importation of dietary supplements and components that will be subject to certain provisions of the dietary supplement Current Good Manufacturing Practice regulation (CGMPs)
  • Importation by a very small importer averaging less than $1 million per year of sales of human food during the 3-year period preceding the applicable calendar year.
  • Importation of certain food from a foreign supplier that the FDA has officially recognized as comparable or equivalent to that of the United States (Australia, Canada, and New Zealand); if compliant.
What food products are exempt from FSVP?
  • Juice, fish, seafood, and certain ingredients for use in juice and fish and seafood products subject to the HACCP regulations (21 CFR part 120 or 123).
  • Low-acid canned foods (LACF) and certain ingredients for use in LACF products, but only with respect to microbiological hazards covered by FDA's low acid canned food requirements in 21 CFR part 113.
  • Certain alcoholic beverages, meat, poultry, and egg products.
  • Food imported for research or evaluation
  • Food imported for personal consumption
  • Food transshipped through the US or imported for processing and future export.
  • Food processed, raised, or grown in the US, exported, and returned to the US without further processing.
